Effective date: October 31, 2026. Please read these Terms carefully before using TAPTHAT (the โGameโ). By accepting, you agree to these Terms. If you do not agree, do not use the Game.
The Game is provided by its owner/operator (โOperator,โ โwe,โ or โusโ). The Operator's legal identity and contact information must be supplied before public/commercial release. These Terms govern use of the Game and any updates, content, features, and related services provided by the Operator.
You must be at least 18 years old to access or use TAPTHAT. By accepting these Terms or using the Game, you represent and warrant that you are 18 years of age or older and have the legal capacity to enter into this agreement. Individuals under 18 are not permitted to access or use the Game, even with parental or guardian permission. If you do not meet this age requirement, you must decline these Terms and refrain from using the Game. Use of the Game must comply with applicable laws and regulations in your jurisdiction.
Subject to compliance with these Terms, the Operator grants you a personal, limited, revocable, non-exclusive, non-transferable license to access and play the Game for lawful, non-commercial purposes. No ownership or intellectual-property rights are transferred.
The Game's original source code, visual design, layout, graphics, artwork, text, animation, interface, sound, gameplay presentation, and other protectable original elements are proprietary to the Operator or their respective licensors and are protected by applicable copyright, trademark, trade-secret, and other laws to the extent those laws apply. The name TAPTHAT and associated branding may be protected where rights exist.
Except where expressly authorized in writing or permitted by applicable law, you may not copy, reproduce, redistribute, republish, sell, license, sublicense, commercially exploit, create unauthorized derivative works from, or make available the Game or its protected assets, in whole or in part. You may not remove copyright or ownership notices, impersonate the Operator, or falsely claim authorship or ownership. You may not extract or reuse proprietary assets or code for competing products without authorization.
Important legal limit: Copyright generally protects original expression, not abstract ideas, rules, mechanics, or concepts. Nothing in these Terms restricts lawful fair use, interoperability, reverse engineering where non-waivable law permits it, or other rights that cannot legally be waived. No claim of registered copyright, trademark, patent, or exclusive ownership of generic game mechanics is made here.
Do not interfere with or disrupt the Game, exploit vulnerabilities, introduce malicious code, bypass technical safeguards unlawfully, or use the Game to violate the rights of others. Do not misrepresent affiliation with the Operator or use the Game for illegal activity.
The Game may let you select a photo from your device to display locally. Only select images you have the right to use. Do not upload or display unlawful, exploitative, or non-consensual imagery. In this standalone version, selected photos are processed locally in the browser and are not sent to an Operator server by the Game. Your browser or operating system may handle local files and caching independently. Photos may be lost on reload or when the tab closes.
TAPTHAT is provided solely for entertainment purposes. Use of the Game is voluntary and entirely at your own risk. You are responsible for deciding whether the Game and its features, including vibration functionality, are suitable for your circumstances and device. Stop using the Game immediately if you experience discomfort, pain, irritation, numbness, or any other adverse effect. The Operator does not guarantee that the Game will be uninterrupted, error-free, or suitable for any particular purpose. Nothing in this section excludes or limits any rights or liabilities that cannot lawfully be excluded or limited.
AUTOPHORIA MODE โ Intended Purpose and Restrictions: AUTOPHORIA MODE is provided exclusively as a custom vibration rhythm synthesizer for entertainment purposes. Its sole intended function is to generate and demonstrate customizable vibration rhythms, pulse sequences, and timing patterns on supported devices. AUTOPHORIA MODE is not intended or authorized for any other purpose. By using AUTOPHORIA MODE, you agree to use it only for this stated purpose and at your own risk.
The Game can trigger device vibration, including rapid or prolonged patterns. Vibration may be uncomfortable, distracting, or unsuitable for some people. You control whether to enable vibration and should stop immediately if you experience discomfort, numbness, pain, irritation, or other adverse effects. Do not use while driving, operating equipment, or in any setting requiring attention. Avoid prolonged continuous use; take breaks. Device behavior depends on browser, operating system, and hardware. The Game is entertainment only and is not a medical or therapeutic product.
The Game is provided on an โas isโ and โas availableโ basis to the extent permitted by law. Features may change or be removed. Browser restrictions, battery settings, background suspension, hardware support, and operating-system policies may interrupt animation, timing, sound, or vibration. We do not guarantee uninterrupted or error-free operation.
The Game may save high scores or settings in local browser storage. This data can be lost when browser data is cleared, private browsing ends, or files are moved. No guarantee is made that scores will persist or be recoverable. The standalone Game does not require account registration.
In this standalone version, gameplay runs locally in your browser. The Game does not intentionally transmit your selected photos, scores, or gameplay data to an Operator server. Browser vendors, operating systems, or any separately added hosting or analytics services may process information under their own policies. A separate privacy notice should be provided if online services, advertising, analytics, accounts, or data collection are later added.
Third-party names, images, trademarks, and other materials remain the property of their respective owners. You are responsible for ensuring that any photos you select do not infringe another person's rights. References to third parties do not imply sponsorship or endorsement.
To the fullest extent permitted by applicable law, the Operator disclaims implied warranties of merchantability, fitness for a particular purpose, and non-infringement. To the extent permitted by law, the Operator will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of the Game. Nothing excludes liability that cannot lawfully be excluded, including liability for fraud, willful misconduct, or personal injury where such exclusions are prohibited.
Your permission to use the Game ends if you materially violate these Terms. You may stop using the Game at any time. Clauses that by nature should survive termination, including intellectual-property protections and lawful limitations of liability, will survive.
The Operator may update these Terms. Material changes should be communicated before they take effect where required by law. Continued use after presentation of revised Terms may require renewed acceptance.
Applicable law and mandatory consumer protections depend on your location and the Operator's legal jurisdiction. No specific forum, governing-law jurisdiction, or mandatory arbitration clause is designated in this draft. Any dispute-resolution provision added later must comply with applicable law and provide appropriate notice.
